AUTOMATIC TRANSMISSION WARRANTY

Remanufactured automatic transmissions are warranted by ACCURATE TRANSMISSIONS a division of 585052 B.C. Ltd. (WARRANTOR) against failure caused by defects in material and workmanship for a period of one year or 20,000 kilometers, whichever occurs first.

The warranty period begins on the date of delivery to the installer and applies to the party appearing on the warrantors invoice. If later repairs on parts and labour purchased are necessary, within the time and mileage specified in the terms of this warranty, then it will be provided without charge to the buyer within the limits of this warranty at the warrantors shop.

This warranty covers parts, labour, and cost of replacing transmission fluid only. This warranty is only extended to the customer named. It does not cover such things as towing, car rentals, freight charges, loss of use, loss of earnings, personal injury damages, per diem expenses, nor any other consequential or incidental damages. The warrantors obligation under this warranty is limited to replacing or repairing defective parts and correcting defectively furnished labour.

The warrantor is responsible only for the parts and labour purchased by the customer on the invoice that promoted the issuance of this warranty. The warrantor is not responsible for subsequent failures of, or damage resulting from related parts or units as shown in the following: examples of items are, but not being limited to: a. levers; b. controls; c. linkage; d. radiator; e. coolers; f. mounts; g. external cooler lines; h. electrical accessories; g. computer control components. The foregoing and other parts are not normally included in or with a transmission repair/replacement.

THIS WARRANTY WILL NOT BE VALID IF THE VEHICLE HAS BEEN USED FOR ANY OF THE FOLLOWING: TOWING OR HEAVY-DUTY PURPOSES UNLESS A PROPER TRANSMISSION COOLER HAS BEEN INSTALLED; NOR WILL IT BE VALID IF THE TRANSMISSION ASSEMBLY HAS BEEN TAMPERED WITH OUTSIDE THE WARRANTORS SHOP; OR IF IT HAS BEEN IMPROPERLY INSTALLED; OR IF THE FAILURE IS A RESULT OF FAULTY ELECTRICAL COMPONENTS SUCH AS COMPUTER CONTROLS, SENSOR ACTUATORS, CONNECTORS, AND WIRING (INCLUDING GROUND CONNECTIONS NOT SUPPLIED WITH THE TRANSMISSION); OR IF FACTORY APPROVED FLUID HAS NOT BEEN USED IN THE ASSEMBLY; OR IF IT HAS BEEN ABUSED DURING OPERATION; OR IF IT HAS BEEN DAMAGED IN AN ACCIDENT. THE WARRANTOR RESERVES THE RIGHT TO REFUND THE FULL PURCHASE PRICE OF GOODS AND SERVICES PURCHASED HEREIN; IN LIEU OF ANY CLAIM UNDER THIS WARRANTY.

The warrantor will not be responsible for damage or charges resulting from the following: failure to thoroughly flush the transmission cooling system prior to installation of the replacement unit; failure to inspect for leaks before and after driving vehicle after installation of replacement unit; failure to inspect vacuum hose, cooler lines and fittings, electrical wiring etc. that may affect the operation of the transmission; failure to keep adequate fluid in the transmission; and failure of external electronics and computer controls.

Reimbursement for labour cost for removing and replacing a defective part is limited to $38.00 per hour, based upon time allowed in Mitchell Flat Rate Manuals. In order to make a valid claim for adjustment under this warranty, the purchaser must, if requested, return the transmission to the warrantor within the warranty period for inspection. Should the transmission be accepted as defective, it would be repaired or replaced at no charge and returned to the purchaser. The warrantor reserves the right to determine whether to replace or repair its products. The warrantor reserves the right to make the repairs themselves. IMPLIED WARRANTY: The warranty terms here in apply to both written and implied warranties. All implied warranties are limited to the terms of the written warranty. Consequential or incidental damages are not covered by this warranty. Some States/Provinces do not allow limitations on how long an implied warranty lass, or the exclusions or limitation of incidental or consequential damages; therefore, the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may have other rights, which can vary from jurisdiction to jurisdiction.
